Workers Compensation claim fraud is the receipt of Workers Compensation benefits, to which the claimant is not entitled. This implies that a benefit is being obtained by fraud, by deception. This may be through an act, or an omission. The claimant may actively committing fraud by working elsewhere, setting up a home business, or working for cash. It may be by failing to report a recovery, and includes things such as a failure to engage in return to work activities. It may be necessary to investigate, to establish evidence of the deception.

For those that go through Government insurance, you usually require a good week of surveillance, up to 7 days, depending on information. For those who are self insured there is a greater onus on the gathering of evidence. This is often run by the HR section. This may involve multiple periods of observation, over an extended time frame, for more serious, or long term, claims. The self insured do not have anyone to pass their insurance responsibility for evidence gathering on to.
Those that went through a broker are caught in the middle. The broker has gone to a number of firms they have a relationship with, to get a quote. The client often goes with the cheapest quote. This means the insured may have to spend more time gathering evidence, as the insurer does not have the margin.
